Supplementary affidavit filed on behalf of the applicant in Court today is taken on record.

Heard Ms. Sufia Saba, learned counsel for the applicants and learned A.G.A. for the State.

The present 482 Cr.P.C. application has been filed seeking a direction upon the court below i.e. Additional Chief Judicial Magistrate IInd, Rampur to decide the Case No. 427 of 2018 (State Vs. Mohd. Zafar & Others) arising out of Case Crime No. 319 of 2017, under Sections 406,420 and 120-B I.P.C., Police Station-Kaimeri, District-Rampur.

After hearing the learned counsel for the applicants and learned A.G.A. for the State and perusing the materials brought on record as well as without expressing any opinion on the merits of the case, this application is disposed of by providing that the court below court below i.e. Additional Chief Judicial Magistrate IInd, Rampur shall decide the Case No. 427 of 2018 (State Vs. Mohd. Zafar & Others) arising out of Case Crime No. 319 of 2017, under Sections 406,420 and 120-B I.P.C., Police Station-Kaimeri, District-Rampur in accordance with Section 309 Cr.P.C., expeditiously preferably within a period of three months from the date of production of a certified copy of this order, if there is no legal impediment.

The District Judge concerned is also directed to monitor the case in the monthly meeting of Monitoring Cell. The District Judge and the Superintendent of Police, Rampur shall also ensure the presence of witnesses as and when they are summoned by the Court concerned.
