Short counter affidavit, filed today, taken on record.

Heard Sri S.N. Mishra, leaned counsel for the applicants and learned A.G.A. on behalf of State.

This application under Section 482 Cr.P.C. has been filed for quashing entire proceedings of Case No.605 of 2015 (State Vs. Smt. Gulaba Devi and others) under Sections 420 IPC, P.S. Harraiya, District Basti, pending before the Judicial Magistrate Court no. 12, Basti.

Learned counsel for the parties have stated that primarily the present proceedings under challenge arises out of the dispute regarding immoveable property between the parties. The applicants and opposite party no. 2 have also instituted a civil suit being O.S. No.389 of 2014 and now the parties have settled their differences and have entered into compromise and on account of it, the civil suit has been decreed vide order dated 23.5.2018.

In para-6 of the short counter affidavit, it is stated that both parties have decided that the proceedings be quashed as the parties have settled their differences.

Considering the facts and circumstances of the case and the submissions advanced by learned counsel for the parties regarding the compromise entered into between the parties, no useful purpose would be served in keeping the application pending.

The application is allowed. The proceedings of Case No.605 of 2015 (State Vs. Smt. Gulaba Devi and others) under Sections 420 IPC, P.S. Harraiya, District Basti is hereby quashed.
