Learned A.G.A. mentioned that this charge sheet is for offence punishable under Section 3(2)(va) of the Scheduled Castes and Tribes (Prevention of Atrocities) Act besides other offences of I.P.C. and the cognizance over it has been taken in amended Act. The order of Special Judge, SC/ST Act, is appealable under Section 14 of the Act, hence applicants are required to file appeal against the same.
Upon this argument, learned counsel for applicants does not want to press this proceeding with liberty to file appeal as above.
The application is disposed of with aforesaid liberty.
