Heard learned counsel for the petitioners; Sri B.D. Pandey for the respondents 2 and 3; Sri Rohit Pandey for the respondent no.1; and perused the record.

The present petition seeks for a direction upon the respondent University to return the fees deposited by the petitioner for admission in B.Tech Ist Semester, 2017-18.

It appears from the record that already in respect of refund of fee, a representation has been made by the petitioner to the institution concerned. There is also an alternative prayer of the petitioner for a direction upon the third respondent to pass appropriate and reasoned order on his representation in respect of refund of fees.

Under the circumstances, without expressing any opinion on the merits of the claim of the petitioner, this petition is disposed of by giving liberty to the petitioner to make a comprehensive representation to the third respondent with copy to the second respondent. If any such representation is made along with certified copy of this order, within a period of 15 days from today, the same shall be decided by a reasoned and speaking order within four weeks from the date of receipt of such representation. If it is found that the petitioner is entitled to any refund, then the same shall be made, within a period of three weeks from the date of taking of such decision. If the respondents are of the opinion that the petitioner is not entitled to refund then reasons for the same shall be recorded and communicated to the petitioner within the period stipulated above.
