This writ petition, inter alia, has been filed for the following reliefs;

"A. Issue a writ in the nature of mandamus directing the respondent no. 2 to 4 to not interfere in the legal and valid construction of the petitioner continuing over the plot no. 392/1 area 0.030 hec. (1/3 share) situated in Village- Pata, Pargana-Karari, Tehsil-Manjhanpur, District Kaushambi in pursuant to the lay out plan sanctioned as annexure no. 2 to the writ petition.

B. Issue a writ order or direction in the nature of mandamus directing the respondents to take appropriate majors to protect the person and property of the petitioner in pursuant to the enquiry report dated 24-10-2018, 29-092018 and 3-10-2018 (annexed as annexure no. 4 to the writ petition) and take appropriate recourse of law for disposal of the representation dated 28.09.18 and 24.11.2018 (annexed as annexure no. 5 and 6 to the writ petition)."

Heard learned counsel for the parties and perused the record.

Learned counsel for the petitioner stated that the petitioner is a lawful owner of the land in question and the lay out plan of the same has been sanctioned by the concerned authority of Nagar Panchayat Manjhanpur, Kaushambi but still the Respondent No. 3, Sub Divisional Magistrate, Manjhanpur, District Kaushambi is causing hindrance illegally in the peaceful possession and construction on the land in question.

Considering the facts and circumstances of the case and the submission made by the learned counsel for the petitioner, the writ petition stands finally disposed of with a direction to the authorities concerned not to interfere in peaceful possession and construction of the house over the land/plot in question except in accordance with law.
