This writ petition has been filed, inter alia, for the following relief;

"i) issue a writ, order or direction in the nature of Mandamus commanding to the respondent authorities to consider the grievances of the petitioner and allow to run his shop in behind to the boundary wall of the U.P.S.R.T.C. Workshop Kalp Road Kanpur, during the pendency of the writ petition.

ii) issue a writ, order or direction in the nature of Mandamus commanding to the respondent authorities to allot the land for shop of the petitioner in behind to the boudnary wall of the U.P.S.R.T.C. Workshop Kalpi Road Kanpur, in the interest of justice;"

Learned counsel for the petitioner has confined his prayer to the extent that the petitioner may be permitted to make a fresh representation before the concerned authority in respect of his grievances with a direction to the concerned authority to decide the same within a stipulated period.

Heard learned counsel for the petitioner, Sri Alok Mishra, learned counsel for the Nagar Nigam, Sri Anoop Singh, learned counsel for the Respondent No. 5, Kanpur Development Authority, learned Standing Counsel and perused the record.

Considering the facts and circumstances of the case, this writ petition is finally disposed of with a direction to the petitioner to make a fresh representation before the Respondent No. 4, Commissioner, Nagar Nigam Kanpur, Kanpur Nagar ventilating his grievances within 10 days from today along with a certified copy of this order enclosing therewith a copy of the writ petition and its Annexures and, if any such representation is made, the said authority shall make all endeavour to consider and decide the same by a speaking order after giving opportunity of hearing to the petitioner in accordance with law expeditiously preferably within three weeks from the date of

receipt of the said representation.

We make it clear that we have not entered into the merits of the case and the same shall be decided by the authority concerned on its own merits. Order Date :- 14.12.2018
