Heard Sri Santosh Tiwari, Advocate holding brief of Sri Prabha Shanker Pandey, learned counsel for the petitioner and Sri S.N. Shukla, learned Standing Counsel for the respondents.
The petitioner in the writ petition is seeking a direction to the respondents to remove the name of State of U.P. from the plots no. 158, 163, 165, 167 and 174 situated at Village Sadiyapur, Tehsil Sadar, District Allahabad and to enter the name of the two petitioners in the revenue record over the said plots.
No useful purpose would be served in keeping the petition pending.
The writ petition is disposed of with a direction that if the petitioners submit an application before the Respondent no.-4Sub-Divisional Magistrate, Tehsil Sadar, District Allahabad in respect of the relief claimed in this writ petition within 15 days from today along with the certified copy of this order, the Respondent no.4 shall consider and decide the same in accordance with law, within a further period of three months.
It is made clear that the Court has not adjudicated the claim of the petitioner on merit.
