Heard learned counsel for the petitioner as well as learned Standing Counsel appearing for the State respondents and Sri Manish Kumar Nigam, learned cousel appearing for the respondent no. 4.

Present writ petition has been filed with the following prayer:

"A- Issue a writ, order or direction in the nature of certiorari quashing the order, dated 19.09.2018 passed by the Up-zila-adhikari, Sadar, Gorakhpur in case no. 6508/2014, Computer case no. T-20140531036508 - Gangotri Devi Vs. Sahayak Vikas Adhikari, under section 6-A of UP Panchayatraj (Maintenance of Family Register) Rules - 1970 of village-Dohariya Kusahar, Tappa-Gauta Pargana-Haveli, Tehsil Sadar, District - Gorakhpur and the order dated 03.01.2013 passed by the respondent no. 2 Sahayak Vikas Adhikari (Panchayat) Junge kaudiya, Tehsil - Sadar, District - Gorakhpur to including the name of the respondent no. 4 - Smt Subhawati Devi in house no. '264' in Family Register of village - Kushahara, post office and nyay Panchayat - Dohariya, Sadar, Tehsil - Sadar, District - Gorakhpur.

B-Any other writ, order or direction in the nature as this Hon'ble court may deem fit and proper under the facts and circumstances of the case.

C-Award the cost of petition in favour of the petitioner against the contesting respondents."

At the very outset, learned counsel for the petitioner prays that he may be permitted to withdraw this writ petition with liberty to file a fresh writ petition for the same cause of action.

Sri Manish Kumar Nigam, learned counsel appearing for the respondent no. 4 has no objection.

This writ petition is, accordingly, dismissed as withdrawn with liberty aforesaid.

However, when fresh writ petition is filed, learned counsel for the petitioner shall serve a copy of the writ petition on Sri Manish Kumar Nigam who has put in appearance on behalf of respondent no. 4.
