Heard Sri Anup Kumar Pandey, learned counsel for the petitioner, learned Standing Counsel for respondents no. 1 & 5 and Sri Shyam Singh Yadav, learned counsel for respondents no. 2, 3 & 4.

The petitioner in the writ petition is seeking quashing of the recovery citation dated 10.08.2018 by which a sum of Rs.1,54,246/- is sought to be recovered him as electricity dues. The petitioner is stated to have preferred a representation on 14.8.2018, annexure-3 to the writ petition, before the Executive Engineer upon which the Executive Engineer on 14.8.2018 itself directed that an inquiry be conducted and a report be submitted within a week. The inspection report has been submitted on 16.8.2018, annexure-6 to the writ petition, in which it has been stated that an inspection was conducted and during inspection it was found that there was no theft of electricity by the petitioner.

Learned counsel for the respondents no. 2, 3 & 4 submits that he cannot say whether the document filed as annexure-6 is a genuine document or not.

The writ petition is, therefore, disposed of with a direction to the Executive Engineer, Electric Distribution Division-I, Maharajganj to examine the matter of the petitioner and pass appropriate order in accordance with law within a period of one month from the date of receipt of a certified copy of this order in his office.

Till disposal of the matter by the Executive Engineer, no coercive action shall be taken against the petitioner in pursuance of the impugned recovery citation dated 10.08.2018, annexure-5 to the writ petition.
