Heard the learned counsel for the petitioners and the learned counsel appearing for the BSA, Sri Yatindra.
It has been contended by the learned counsel for the petitioners that the respondent no. 3 is impersonating himself as Manager of the Committee of Management running the Junior High School, Ajnara Naglia Block and Tehsil Shikarpur, District Bulandshahar. The petitioner being the elected Manager of the said Committee of Management since 2012, has filed an application to the BSA to pass appropriate orders thereon.
From a perusal of the representation dated 5.5.2018, it has been pointed out by the learned counsel for the respondent no. 2 that there seems to be a private dispute between the petitioner and the respondent no. 3 in which the BSA has no concerned.
The contention of the learned counsel for the respondent no. 2 is apparently correct. If the petitioner is aggrieved by inaction of the respondent no. 3, he may file an appropriate Suit for declaration / permanent injunction before the competent Civil Court.
The writ petition is dismissed.
