Heard learned counsel for the petitioners and the learned counsel appearing for the Basic Education Officer.

The petitioners have prayed that on complaint made by them, the District Basic Education Officer has submitted a report to the District Magistrate, Jaunpur by letter No. 283 dated 17.05.2017 to the effect that the Block Education Officer, Jaunpur has conducted an enquiry and found that the respondent is functioning without recognition and therefore, its functioning was stopped however, no further action has been taken by the Basic Education Officer thereafter for cancelling their recognition, if any, granted to the respondent No. 5 Institution.

This Court finds that in the letter of the District Basic Education Officer, Jaunpur there is a clear mention that the school in question was running without meeting the standards prescribed under the Statute and therefore, its functioning was stopped. No other action has been taken by the Basic Education Officer, although, he was duty bound to issue show-cause notice to the respondent No. 5 and after receiving the reply take appropriate steps for cancelling recognition of the said school.

This Court therefore, disposes off this writ petition with a direction to the respondent No. 4 to look into the grievance of the petitioner and pass appropriate, reasoned and speaking order thereon within a period of six weeks from the date a certified copy of this order is produced before him after giving opportunity of hearing to all concerned.
