Heard learned counsel for the petitioners. Learned Standing Counsel has appeared for the respondents and Sri Neeraj Dubey, learned counsel for the National Highways Authority of India.

Land of Araji No.31 sitatue in Mauja Rumipur @ Ghayghat, Tehsil Chunar, Pargana Bhagwat, District Mirzapur has been acquired under the National Highways Act, 1956 (hereinafter referred to as the Act). In respect of the said acquisition award has also been made by the Competent Authority.

The grievance of the petitioners is that names of certain persons were wrongly recorded against the aforesaid land but they are not entitle to any compensation.

In view of the above, the dispute is regarding entitlement and apportionment of the compensation in respect of the aforesaid land for which the petitioners can make appropriate application before the competent authority under Section 3H of the Act.

In view of the said alternative remedy, we do not feel inclined to exercise our discretionary jurisdiction and the petition is dismissed with liberty to the petitioner to make appropriate application in this regard before the Competent Authority.

In case any such application is filed the same shall be considered and decided in accordance with law most expeditiously.

The Writ Petition is dismissed .
