Heard Sri Ram Kumar Dubey, learned counsel for the petitioner and Sri Pranjal Mehrotra, learned counsel for the Electricity Corporation.
Towards electricity dues a demand of Rs. 2,00,162/- was made on 7.12.2017. In response thereto learned counsel for the petitioner submits that he deposited a sum of Rs. 49,000/- on 15th May, 2018. Now, again a demand notice dated 18.7.2018 has been issued for a sum of amount of Rs. 2,00,162/-. The grievance raised in this writ petition is that the said demand notice has been issued without adjusting the amount already deposited by the petitioner.
We are of the view that the appropriate authority to look into grievance of the petitioner is the Executive Engineer before whom the petitioner may apply and, therefore, the Executive Engineer is directed to consider the claim of the petitioner and pass appropriate order in accordance with law within one month from the date a certified copy of this order along with fresh application is presented before it.
With the aforesaid observations/directions, the writ petition is, accordingly, disposed of.
