By impugned notice dated 28.4.2018, the District Basic Education Officer, Moradabad has called upon the petitioner institution to forthwith close the same, inasmuch as it is being run without having recognition under the provisions of Right of Children to Free and Compulsory Education Act, 2009 and the rules framed thereunder.

Counsel for the petitioners does not dispute that the recognition, which was there in favour of the petitioner institution under the law prevalent at that time, had expired in the year 2013 and that the petitioner institution does not have any recognition under the provisions of the Right of Children to Free and Compulsory Education Act, 2009. He seeks liberty to file an application for obtaining recognition under the present Act.

In view of the statement made by learned counsel for the petitioners, the instant writ petition is disposed of with liberty to the petitioner institution to file fresh application seeking recognition under the provisions of the Right of Children to Free and Compulsory Education Act, 2009. It is further provided that in the event, any such application is filed, the same shall be dealt with in accordance with law.
