The petitioner is the Committee of Management of Dr. Dhirendra Singh Smark Uchchatar Madhyamik Vidyalaya, Rith Chandausi, Sambhal. It has assailed the order dated 13.4.2018, by which the Regional Secretary, Bareilly has communicated deficiencies in the application submitted by the petitioner institution seeking recognition to run classes from standard VI to X (High School). It is noted in the said order that it would not be possible to reconsider the request for examination year 2020 but similar request in future, shall be considered, if application is made in prescribed format and within the time prescribed. The petitioner has also challenged the communication dated 20.4.2018 sent by the Regional Secretary, Bareilly to the Secretary, Secondary Education Board, U.P. Allahabad, wherein it is mentioned that the report of District Inspector of Schools called for by the previous letter having been received after meeting of Recognition Committee held on 27.3.2018, it would not be possible to consider the case of the petitioner institution for recognition during the current academic year.

Today, when the matter is taken up, a short counter affidavit has been filed by the Secretary, Secondary Education Board, U.P., Allahabad and in paragraph 7 whereof, it is stated that having regard to the fact that defects have been removed and District Inspector of Schools has submitted his comments on 5.4.2018, the matter regarding grant of recognition to the petitioner institution will be placed for consideration by the Recognition Committee in its next meeting which is likely to be held in the month of May-June 2018.

In view of above stand taken in the counter affidavit filed by the Secretary, Board of Secondary Education, U.P., Allahabad, the instant writ petition is disposed of accordingly. The respondents shall ensure that the matter relating to grant of recognition to the petitioner institution for running classes from standard VI to X (High School) is taken up for consideration in the next meeting as per the stand taken before this Court.
