Learned counsel for the petitioner apprised to the Court that the petitioner had applied for the post of Assistant Teacher in Science/Maths in pursuance to the advertisement issued in the year 2013 for recruitment of 29334 of Science/Maths teachers in Senior Basic School. Learned counsel for the petitioner further submits that earlier by the Government Order dated 16.07.2010 appended as Annexure 7 to the Writ Petition, the candidates, those posses B.BA, Bachelor of Music and Bachelor of Arts, can apply under Arts category and the candidate, those posses the BCA, B.Tech., B.E., B.U.M.A., B.B.S., B.Pharma, BSC (Forest), can apply under Science category. The petitioner being professional graduate/B.Pharma and B.T.C., in terms of the aforesaid advertisement, has applied and appeared in the counselling at District Gorakhpur and declared selected candidate. He further apprised to the Court that in the similar circumstances, the Department has already granted appointment letters to several candidates and drawn the attention of this Court on page 77 of paper book whereby one Anand Kumar s/o Surendra Pal Verma having qualification of B.Pharma degree has been offered appointment. He has also placed reliance on page 81 of the paper book wherein it has been mentioned that one incumbent namely Santosh Kumar Bharti has also been appointed as Assistant Teacher in Science/Maths having B.Pharma degree to his credit and as such it is sought to be contended that the case of the petitioner cannot be denied.
