Heard learned counsel for the petitioner and learned Standing Counsel. Shri B.P. Singh appears for respondent nos.2 and 3. Shri Deepak Kapoor appears for fourth respondent.

The petitioners are before this Court for a direction to the respondents to release the insurance money along with interest as admissible under law to the petitioners along with consequential benefit, which falls due continuously upto date of actual payment to the petitioners.

On the matter being taken up on 6.2.2018, learned counsel for the respondent was asked to seek instructions. Today when the matter is taken up, Shri Deepak Kapoor, learned counsel for fourth respondent, on the basis of instructions dated 20.02.2018 sent by the Sr. Branch Manager P & GS Unit Allahabad, submits that so far as the claim of petitioner nos.2, 5, 6, 7, 8, 9, 10 and 11 is concerned, the amount in question had been sent vide cheque no.215459 dated 29.11.2017 totalling Rs.48,48,786/- to FAO (Basic Shiksha), Azamgarh and the amount of cheque has been debited from the concerned bank account on 28.12.2017. So far as the claim of petitioner nos.1, 3 and 4 is concerned, it is informed that exact letter reference number and date of FAO is required so that needful may be done.

The Court has proceeded to examine the record in question and find that once LIC claim of petitioner nos.2, 5, 6, 7, 8, 9, 10 and 11 has been released by LIC and the same has also been credited in the account of FAO (Basic Shiksha) Azamgarh, the Basic Shiksha Adhikari concerned is hereby directed for ensuring that the aforesaid amount may be credited in the account of aforesaid petitioners. So far as the claim of petitioner nos.1, 3 and 4 are concerned, they are at liberty to move appropriate representation along with their details before the fourth respondent within two weeks and in case the same is furnished and found to be admissible, the Court hope and trust that the amount in question would be credited in the account of the Finance and Accounts Officer concerned and thereafter would be paid to the petitioner forthwith.

The writ petition is disposed of accordingly.
