Heard learned counsel for the parties.

The petitioner is before this Court with request to issue direction to the respondents to make an enquiry against the respondent no.8 with regard to his illegal appointment on the post of Principal at Smith Inter College, Azamgarh and take appropriate decision for initiating a departmental proceeding against respondent no.8.

Learned counsel for the petitioner submits that regarding his grievance, the petitioner has already represented the matter before the Joint Director of Education, Azamgarh Region, Azamgarh, who has been arrayed as third respondent, on 6.9.2017. He has confined his prayer only to the relief that his representation dated 6.9.2017 may be considered by the appropriate authority.

Learned Additional Chief Standing Counsel for the State respondents has no objection to the said prayer.

No useful purpose would be served in keeping the writ petition pending.

In view of above, without expressing any opinion on the merits of the issue and considering the facts and circumstances of the case, this writ petition is disposed of finally with a direction to the Joint Director of Education (Secondary), Azamgarh Region, Azamgarh to decide the petitioner's representation after hearing respondent nos. 7 and 8 in accordance with law within a period of two months from the date of production of a certified copy of this order before him.
