Heard Shri Vinay Kumar Singh, learned counsel for the petitioner, learned Additional Chief Standing Counsel for the State respondents as well as Shri Sanjay Chaturvedi for the fifth respondent.

The petitioners are before this Court with request to issue direction to the respondents to pay salary and arrears of trained teacher's pay scale to them.

Record in question reflects that earlier the petitioners had been before this Court by preferring Writ A No.1860 of 2006 (Arvind Kumar Singh and others vs. State of UP and others) for direction to the respondents for their exemption from training and to provide trained teacher's pay scale in view of the Government Order dated 21.10.1994. The said writ petition was disposed of by this Court on 16.2.2006 asking the petitioners to file a representation before the Regional Assistant Director of Education (Basic), Azamgarh within three weeks from the date of order and the same was directed to be disposed of within next four weeks. If the petitioners are found to be entitled to the benefit of such exemption from training under law, then they shall be given the grade of Assistant Teacher and pay of scale accordingly.

Learned counsel for the petitioners states that in compliance of the aforesaid order dated 16.2.2006, the exemption from training has already been accorded to the petitioners by the Assistant Director of Education (Basic) on 8.5.2008 and the petitioners were appointed on the post of Assistant Teacher in the pay scale of Rs.9300-34800 on 3.4.2012. He precisely submits that even though the direction was issued by this Court while disposing the aforesaid writ petition on 16.2.2006 to accord benefits of the Government order dated 21.10.1994 but the same has not been extended to the petitioners which has impelled to them to approach this Court.

No useful purpose would be served in keeping the writ petition pending.

In view of above, without expressing any opinion on the merits

of the issue and considering the facts and circumstances of the case, this writ petition is disposed of finally with a direction to the Regional Assistant Director of Education (Basic), Azamgarh to look into the greivance of the petitioners and pass appropriate order after seeking comments from the District Basic Education Officer, Ballia in accordance with law within a period of three months from the date of production of a certified copy of this order before him
