The matter has been taken up in the revised call. Learned counsel for the petitioner is not present though the name of learned counsel for the petitioner is shown in the cause list. Learned Standing Counsel on behalf of State is present.
The petitioner has assailed the order dated 18.7.2008 passed by the District Development Officer, Farrukhabad transferring him from Block Kayamganj to Block Nawabganj, in District Farrukhabad. The transfer has been made within the district. The transfer order is incident of service and no employee has a right to continue indefinitely at one place of posting. No subsequent development has been brought in the record by the petitioner. The order of transfer can be assailed on the limited ground of having been actuated by malice or in case it has been passed in violation of statutory provisions. From the pleadings in the record neither the malice nor violation of any statutory provision is made out.
The writ petition is dismissed.
