Heard Sri Anand Kumar Pandey, learned counsel for the petitioner and Sri R.P. Dubey, learned Addl. Chief Standing Counsel for the State respondents.

The petitioner claims to have been appointed on 08.09.1972 as clerk in the institution namely B.D. Bajauriya Inter College, Saharanpur. Thereafter, it has been stated that due to his ill health (chronic problem) the petitioner did not attend his duties from 01.05.2006 (near about 12 years).

Now by means of this writ petition, the petitioner claims to have retired in the year 2013 and is entitled for pensionary benefits and for the same he has submitted various representations and the same is pending.

Sri Dubey, fairly states that the grievance of the petitioner with regard to his pensionary benefits shall be examined and thereafter appropriate orders may be passed.

Without entering into the merits of the claim made by the petitioner, the present writ petition is disposed of with liberty to the petitioner to approach the respondent no.3 - Deputy Director of Education, Saharanpur Region, Saharanpur by filing a fresh representation along with a certified copy of this order within two weeks from today, who will consider the claim of the petitioner and pass appropriate orders after hearing the respondent no.6 as well as petitioner within a further period of eight weeks.

With the aforesaid observation, the writ petition is finally disposed of .
