The claim of the petitioner for payment of gratuity has been rejected by order dated 30.11.2017 passed by the respondent No.3.

Sri Laxmi Kant Misra, learned counsel for the respondent No.2 and 3 submits that the petitioner has an alternative and efficacious remedy of filing an appeal against the order assailed in the instant writ petition.

Learned counsel for the petitioner does not dispute the existence of the alternative remedy. Learned counsel for the petitioner submits that at this stage, he would not like to press the reliefs sought in the instant writ petition. He submits that the petitioner is willing to avail the alternative remedy under Rule 25 of the Uttar Pradesh Agricultural Produce Markets Board (Officers and Staff Establishment) Regulations, 1984.

In such view of the matter, the prayer in the instant writ for quashment of the order dated 30.11.2017 is rejected. It is open to the petitioner to file an appeal before the competent authority constituted under the aforesaid provision. In case such an appeal is filed within a period of three months, the competent authority shall decide the appeal on merits without going into the question of limitation. The competent authority shall decide the appeal within a period of four months from the date of receipt of a certified copy of this order along with the memo of appeal.

With the aforesaid direction, the writ petition is disposed of.
