In this transfer application filed by the plaintiff-applicant for transfer of Original Suit No. 29 of 2015, which is a suit for damages.

The ground for seeking transfer is that the plaintiff-applicant is a practising lawyer and under orders passed by the High Court he has been debarred from entering the Court complex in District Auraiya as he was found guilty of contempt. It is therefore the case of the applicant that since his entry into the Court complex is barred, he is unable to prosecute his suit and hence the prayer for its transfer.

Learned Standing Counsel has opposed the transfer application.

However, looking into the facts and circumstances and since the applicant is a lawyer whose entry into the Court complex stands barred till August, 2020, the transfer application is liable to be and is hereby allowed.

Original Suit No. 29 of 2015 (Ajay Pandey Vs. State) pending before the Civil Judge (Sr. Division), Auraiya shall stand transferred to District Kanpur Dehat.
