Heard learned counsel for the applicant.

Although, the matter has been called out in the revised call. None has appeared on behalf of the opposite party. Neither any counter affidavit filed on his behalf is available on record.

This is a Transfer application by the wife, seeking transfer of a petition, under Section 13 of the Hindu Marriage Act, filed by the husband at Mirzapur. Transfer of this case is sought to District Allahabad on the ground of convenience.

Apart from the ground of convenience, it has been averred in paragraph 15 of the affidavit, filed in support of the transfer application that proceedings for maintenance under Section 125 Cr.P.C. have been instituted by the applicant, as also a case under the Domestic Violence Act, at Allahabad.

In absence of a counter affidavit, these material allegations made in the affidavit filed in support of this transfer application stand un-rebutted and must necessarily be accepted, as correct.

In my considered opinion, all the cases between the parties are liable to be heard and decided at one place, which will definitely be convenient for all concerned. On this ground alone, this transfer application is liable to be and is hereby, allowed.

Case No.442 of 2016 (Ram Singh Vs. Richa Singh), under Section 13 Hindu Marriage Act, pending in the Court of Principal Judge, Family Court, Mirzapur shall stand transferred to District Allahabad, forthwith.
