Heard Sri Anil Kumar Jaiswal, learned counsel for the petitioner, learned AGA for the respondents-State and perused the record.
It is submitted by learned counsel for the petitioner is that that respondent no. 2 and 3 are not expeditiously conducting investigation in relation to Case Crime No. 59 of 2018 pending investigation at Police Station- Bisrakh, District- Gautam Budh Nagar for the offence under Section 420 IPC.
It is pertinent to notice that matter was sent for investigation in pursuance to order passed by the competent Magistrate as per provisions of sub-Section 3 of Section 156 Cr.P.C.
It is well settled that every investigation requires a definite pace to arrive at a logical consequence and as such delay in that is absolutely unwarranted.
Respondent no. 3- Station House Officer, Police StationBisrakh, District- Gautam Budh Nagar is directed to expedite the investigation and to complete the same as soon as possible preferably within a period of three months from the date the petitioner presents a certified copy of this order before him. In the period aforesaid, respondent no. 2 shall also make all the best efforts to forward the matter to the prosecution for filing a police report before the competent Court.
In view of it, the writ petition stands disposed of.
