Sri Mukhtar Ahmad Ansari, learned counsel for the petitioner and Sri Deepak Mishra, learned AGA for the State are present.
An affidavit has been filed by SSP, Kanpur Nagar through learned AGA which is taken on record.
Learned AGA for the State submitted that SSP, Kanpur Nagar has though made efforts to apprehend respondent no.4 but he is not residing at the place mentioned in the FIR to which learned counsel for the petitioner states that the private respondent has moved a discharge application on the same address.
It is for the Investigating Officer and Police personnel to produce respondent no.4 before the Court in pursuant to the NBW issued against him on 24.5.2018.
SSP, Kanpur Nagar is further directed to execute the NBW issued by the Court below within a period of six weeks from the date of receipt of this order.
With the aforesaid directions, the present petition is disposed of.
