Heard learned AGAs and perused the impugned judgment and order as well as the record of the lower court.

This appeal has been preferred by appellants against the judgment and order of II Additional Sessions Judge, Saharanpur dated 27.2.1998 in Sessions Trial Nos. 498 of 1994 and 500 of 1994, State Vs. Masroor and State Vs. Ramesh, respectively.

From the perusal of the report of the C.J.M.Saharanpur dated 11.5.2018 which is on record of this appeal, it transpires that the both the appellants in this appeal- Masroor and Ramesh have died.

Learned G.A. has submitted that in view of report of CJM- Saharanpur dated 11.5.2018, this appeal is liable to be abated.

In view of the submission made by learned A.G.A. and on perusal of the recitals contained in report of CJM- Saharanpur, this appeal is dismissed as abated.
