Heard learned counsel for the applicant, learned AGA and perused the record.

By means of this application, the applicant who is involved in case crime no. 108 of 2018, under Section 306 IPC, P.S. Baalauni, District- Baghpat, is seeking enlargement on bail during the trial.

Learned counsel for the applicant in support of his application for bail submits that the applicant is innocent. He has been falsely implicated. It is further submitted that the FIR was registered by brother of the deceased against six named accused person including the present applicant under section 306 IPC. The deceased is the wife of Pappu, who died about a year back on account of untimely and for this reason, she was living under immense frustration and depression. The marriage of the deceased was solemnized with Pappu about 20 years back. It is further submitted that only general role has been attributed to all the family members. The applicant is Dewar, who has no concern with the silent allegation made in the FIR. The deceased has committed suicide by hanging herself. As per the postmortem report, the cause of death is strangulation. It is further submitted that there is no dying declaration of the deceased on record and there is no suicide note left by the deceased. It is next submitted that the applicant is in jail since 10.06.2018 having no criminal antecedents except the present one.
