Heard learned counsel for the applicant as well as learned A.G.A. for the State and perused the record.
By means of this application, the applicant who is involved in case crime no.58 of 2018, under Sections 498A, 304B, 201 I.P.C. and Section 3/4 D.P. Act Police Station-Eka, District-Firozabad is seeking enlargement on bail during the trial.
Learned counsel for the applicant submitted that the FIR was lodged by the first informant, father of the deceased against the applicant and six other family members. The allegation is that the deceased was subjected to cruelty and harassment by the members of her matrimonial house in connection with the demand of Rs.four lac and a golden chain as an additional dowry and due to non-fulfillment of the said demand, she was tortured till her death. The body was recovered from fire. The condition of the body was precarious one. The dead body was almost chard. The cause of death could not be ascertained and the viscera is preserved. The applicant is the mother-in-law of the deceased and resides separately along with her daughter and son-in-law at a distinct place. As per prevailing practice of the society, the applicant has been named in the FIR. General and generic role has been attributed to all the relatives of the husband who is still languishing in jail. The applicant is in jail since 17.05.2018, having no criminal antecedents to his credit.
