Heard learned counsel for the applicant, learned counsel for complainant and learned A.G.A. for State and perused the record.

As per prosecution version, on 28.08.2008 at about 5:30 p.m., applicant with co-accused Awadhesh, Kashmir Singh and Pramod have abducted Satyaram husband of informant Smt. Munni Devi.

Learned counsel for the applicant contended that occurrence has been taken place ten years ago. After investigation, police has submitted final report for two times in this case. By the order of Senior Superintendent of Police, Etah further investigation is going on. Senior Superintended of Police has no right to pass order for reinvestigation of the case, in which report under Section 173(2) Cr.P.C. has been put forth. The arrest of co-accused Kashmir, Awadhesh and Pramod has been stayed by the Division Bench of this Court vide order dated 19.04.2018 in Criminal Misc. Writ Petition No. 232/2018 (Pramod and two others Vs. State of U.P. and four others). Applicant is in custody since 15.12.2017.

Learned A.G.A. opposed the prayer of bail, however admitted this fact that police has submitted final report for two times in this case.

Learned counsel for complainant contended that order has been passed by Magistrate on final report, submitted by police. The abduction person Satyaram was not recovered till now.

Considering the facts and circumstances of the case, I find it a fit case for enlarging the applicant on bail.

Let the applicant Kripal Singh be released on bail in Case Crime No. 305/2008, under Sections 364 and 506 I.P.C., Police Station- Jaithra, District Etah on furnishing a personal bond and two sureties in the like amount to the satisfaction of court concerned.

Accordingly, the instant bail application is allowed .
