Counter affidavit has been filed by learned A.G.A. today in the Court, is taken on record.
Heard learned counsel for the applicant, learned A.G.A. for State and perused the record.
As per prosecution version, on 05.10.2017 at about 10:00 p.m. applicant with co-accused Prem Singh, Shiv Singh, Jainendra @ Motu, Anoop, Tunday, Shailendra, Sunil, Jugnu, Bande, Neetu, Fodal, Chote Kalle, Raju and one unknown person assaulted police party, as a result whereof the police personnel received injuries.
Learned counsel for the applicant contended that co-accused Tunday @ Yogendra Singh has been enlarged on bail by this Court vide order dated 25.01.2018 in Criminal Misc. Bail Application No. 2673/2018, copy of which attached as Annexure-4 to this affidavit. Other co-accused Sunil and Neetu @ Ajay also have been enlarged on bail by this Court vide orders dated 06.06.2018, 18.06.2018 in Criminal Misc. Bail Application Nos. 21400/2018, 22255/2018 respectively, copies of which produced for perusal. The role of applicant is similar to that of co-accused. The applicant is involved in other two cases in which he is on bail. Applicant is languishing in jail since 18.03.2018.
