This is second bail applicant on behalf of the applicant.

Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record.

The present bail application has been filed by the applicant in S.S.T. No. 151 of 2007 arising out of Case Crime No. 221 of 2007, under Section 393 IPC, Police Station - Chhatta, District - Agra, with the prayer to enlarge him on bail.

It is submission of the learned counsel that the first bail application of the applicant was rejected on 15.12.2017 on the ground that detention of the applicant is not sufficient in relation to his default. It is further submission of the learned counsel that applicant is in jail for more than 10 months and he has already suffered for his default and he may be accorded bail.

Whereas learned AGA has opposed the prayer for bail.

Applicant absented from the proceeding on 17.2.2011 whereas he was sent to Jail after his arrest on 9.6.2017. He is in jail for more than ten months for his default of absence of six years and in the opinion of the court he has already suffered sufficiently for his default and now he is entitled for bail.

Let the applicant- Vijay Shanker , be released on bail in the

aforesaid case crime number on his furnishing a personal bond and two local sureties each of the like amount to the satisfaction of the court concerned, subject to the following conditions:

The applicant shall co-operate in the investigation.

The applicant shall not tamper with the prosecution evidence.

The applicant shall not pressurize the prosecution witnesses. 4. The applicant shall appear on the date fixed by the trial Court.

In case of breach of any of the above conditions, it shall be a ground for cancellation of bail. Identity, status and residence proof of the applicant and sureties be verified by the court concerned before the bonds are accepted.
