Learned counsel for the applicants submitted that prosecutrix was major at the time of incident and from the medical examination, she was found 20 years of age. It is further submission of learned counsel for the applicants that medical examination of the prosecutrix was conducted on the direction of this Court in Criminal Misc. Writ Petition No.12495 of 2005 (Pankaj and others vs. State of U.P. and others) by order dated 12.12.2005. It is further submission of learned counsel for the applicants that prosecutrix is living with the applicant no.1 and she has also filed her affidavit alongwith this petition. It is next submission of learned counsel for the applicants that prosecutrix is still living with applicant no.1 as husband and wife and they have married. It is next submitted that a complaint case no.3210 of 2005 (Smt. Neetu vs. Rajendra Singh and others), under Sections 452, 323, 504 and 506 I.P.C. was filed by the prosecutrix against her father wherein she has stated that father of prosecutrix wanted to marry her against her wishes. In her statement it is stated that she has married Pankaj and she is living with Pankaj. The statement of prosecutrix is attached as Annexure No.10 to the petition. It is further submission of learned counsel for the applicants that as per statement of prosecutrix, she is 5th pass, but no school certificate is there to verify her age and her age will be accepted
