Heard learned counsel for the revisionist and learned AGA for the State.
The present application under section 482 Cr.P.C. has been preferred with a prayer to stay the effect and operation of the impugned order dated 4.9.2018 passed by the learned ACJM, Saharanpur in Case No. 618 of 2018 (Smt Preeti v. Naveen Sharma and others)
It is contended by learned counsel for the applicant that the court below has passed the impugned order without application of its mind in a very routine/mechanical manner without going into the facts of the case and prevailing law.
Learned AGA has submitted that the court below has rightly passed the impugned order after considering the merits of the case.
After hearing the learned counsel for the applicant, learned AGA and after perusing the order impugned as well as material on record, there is no illegality or infirmity in the order passed by the court below. Moreover, the learned counsel for the applicant failed to point out any good ground which may warrant interference by this Court for setting aside the order impugned in exercise of its power conferred under section 482 Cr.P.C. jurisdiction.
In view of the aforesaid reasons present Application lacks merit and is accordingly dismissed.
