Heard Sri Mohammad Sadab Khan, learned counsel for the applicant and Sri Abhinav Prasad, learned A.G.A. for the State.

The present 482 Cr.P.C. application has been filed for a suitable direction to the Additional Chief Metropolitan Magistrate 7th, Kanpur Nagar to decide the Case No.5266 of 2016, (Smt. Ankita Srivastava Vs. Sandeep Srivastava and others), under Sections 12, 18, 19, 20, 22 of Domestic Violence Act, pending in the Court of Additional Chief Metropolitan Magistrate 7th, Kanpur Nagar, within stipulated period.

No useful purpose would be served in keeping the petition pending, which is finally disposed of with a direction to Additional Chief Metropolitan Magistrate 7th, Kanpur Nagar to consider and decide the Case No.5266 of 2016, (Smt. Ankita Srivastava Vs. Sandeep Srivastava and others), under Sections 12, 18, 19, 20, 22 of Domestic Violence Act, pending in the Court of Additional Chief Metropolitan Magistrate 7th, Kanpur Nagar, most expeditiously, preferably within a period of six months from the date of production of certified copy of this order, before concerned court below, in accordance with law, after hearing the concerned parties, without granting unnecessary adjournment to either of the party, in case the proceedings of the aforesaid case, is not stayed by any Court.
