Heard learned counsel for the applicant and learned AGA for the State.
This application has been filed by the applicants with a prayer to expedite the trial in Complaint Case No.865 of 2017 (Alisha Khan vs. Numan Sadik Siddique), under Sections-354G, 323, 354, 384, 504, 506 I.P.C. and 66E, 67Ka, 67Kha of I.T. Act, Police Station- Bhadohi, District- Bhadohi pending in the court of learned Additional Chief Judicial Magistrate, Bhadohi, Gyanpur.
It has been claimed that a complaint was filed in the year 2017, since then no worthy action has been taken towards completion of the proceedings of the case and the applicant has been put to unnecessary harassment.
Learned AGA has conceded to the argument of learned counsel for the applicant and submitted that under Section 309 Cr.P.C. it is the bounden duty of the trial court to ensure expeditous disposal of the cases without incurring unnecessary delay.
Considered above submission and considered the entirety of the matter.
Without expressing any opinion on the merits of the case, this application is finally disposed off with a direction to the court concerned to decide the aforesaid case expeditiously, preferably within a period of four months from the date of production of certified copy of this order strictly in accordance with law.
