Heard learned counsel for the applicant and learned A.G.A. for the State.
The present 482 Cr.P.C. petition has been filed for quashing the summoning order dated 25.07.2017 and non-bailable warrant dated 10.04.2018 as well as entire proceeding of Complaint Case No. 611 of 2015 (Bhavneet Kaur Vs. Lavneet Singh and others), under Sections 498-A, 323, 504, 506 I.P.C. and Section 3/4 Dowry Prohibition Act, Police Station Nazirabad, District Kanpur Nagar.
From a perusal of the material placed on the record and the allegations made in the complaint, on the basis of which applicant has been summoned, this Court finds no ground to conclude that the commission of offences is prima facie not made out.
Accordingly, the prayer for quashing of the summoning order, non-bailable warrant and entire proceedings of the complaint case in question is refused.
The Court further notes that non-bailable warrants have been issued against the applicant on 10 April 2018. Learned counsel for the applicant faced with this situation states that the applicant shall appear before the concerned Court on or before 18 June 2018.
In light of the statement so made, which is duly recorded and accepted, the application shall stand disposed of with the following directions:-
The applicant shall surrender before the concerned Court on or before 18 June 2018. Upon such surrender, it shall be open to him to apply for bail. If any such application for bail is made, the same shall be considered and disposed of by the Court concerned bearing in mind the decisions rendered by this Court on the subject.
Till 18 June 2018, no coercive action shall be taken against the applicant. The Court further observes that in the event of failure, as directed above, the Court below shall be free to take all coercive action against the applicant for ensuring his appearance before it.
