Bisht, Standing Counsel for the State. By means of the instant petition, the petitioner seeks directions that certain encroachment, which has been made on public pond in Mauza Mandawali, Pargana Manglaur, Tehsil Roorkee, District Haridwar, may be removed. Various other directions have also been sought. Heard learned counsel for the parties and perused the record. It is the case of the petitioner that certain public utility land has been encroached, and the encroachment has yet not been removed, despite multiple representations having been given to the authorities. Learned State Counsel, under instructions, submits that with regard to the encroachment, a case is pending in the court of Additional Tehsildar, Roorkee, District Haridwar, under Section 122 B of The U.P. Zamindari Abolition and Land Reforms Act, 1950, in which the next date of hearing is 26.09.2025. In fact, the instructions were forwarded on 25.09.2025. The instructions further record that, “Following the settlement of the case, the opponents will be evicted from the land in question as per the rules and action will be taken as per rule and The said land will be freed from encroachment.”
