The present Application has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for quashing the entire proceedings of Criminal Case No.4699 of 2024, “State vs. Parth Dhyani”, pending before the court of Additional Chief Judicial Magistrate/VI^th Additional Civil Judge (Senior Division), Dehradun under Sections 323, 504 and Section 498A of the Indian Penal Code, 1860.

2. Heard Mr. D.K. Sharma, learned Senior Advocate assisted by Mr. Maneesh Bisht, learned counsel for the applicant, Mr. Chitrarth Kandpal, learned Brief Holder for the respondent no.1 and Mr. Abhishek Sati, learned counsel for the respondent no.2/informant-victim.

3. Parth Dhyani, the applicant-accused and the husband of the respondent no.2, is present through video conferencing. He is identified by Mr. Maneesh Bisht, Advocate. Smt. Saloni Doval, the respondent no.2-informant/victim, is present through video conferencing. She is identified by Mr. Abhishek Sati, Advocate.

4. Both, the applicant and the respondent no.2 submitted that there were matrimonial disputes between them. They have settled their disputes. They have filed a Compounding Application (IA No.02 of 2025) and affidavits with their free will and without any pressure.

5. The respondent no.2 has requested to quash the entire proceedings of the said Criminal Case No.4699 of 2024.

6. The said request of the respondent no.2 has not been opposed by the respondent no.1.

Considering the totality of the matter, this Court is of the view that ends of justice would be met if the entire proceedings of Criminal Case No.4699 of 2024, “State vs. Parth Dhyani”, pending before the court of Additional Chief Judicial Magistrate/VI^th Additional Civil Judge (Senior Division), Dehradun, are quashed.

Resultantly, the present Application, filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, is allowed and the entire proceedings of Criminal Case No.4699 of 2024, “State vs. Parth Dhyani”, pending before the court of Additional Chief Judicial Magistrate/VI^th Additional Civil Judge (Senior Division), Dehradun, are hereby quashed.
