		Mr. B.S. Koranga, Advocate for hte petitioner. Mr. J.S. Virk, Deputy Advocate General for the State of Uttarakhand. 2. Petitioner was convicted for an offence punishable under Section 307 I.P.C. and was sentenced to 10 years rigorous imprisonment. The Appeal filed by petitioner against trial Court’s judgment was dismissed by a Co-ordinate Bench of this Court, however, Hon’ble Supreme Court, on petitioner’s Appeal, converted the conviction to Section 304 Part-II I.P.C. and reduced his sentence from 10 years to 3 years.
		3. This writ petition has been filed seeking a direction to competent authority to consider his claim for premature release from jail.
		4. During the course of argument, learned counsel for the petitioner submitted that petitioner has completed sentence of three years. This submission, however, has been disputed by learned State Counsel, who submits that, as per his instructions, petitioner has undergone two years and three days with remission. Thus, from the submission made by learned State Counsel, it is revealed that petitioner is yet to complete the sentence of three years.

mandamus, we dispose of the writ petition with direction to Secretary, Home
Department, Government of Uttarakhand to take decision on petitioner’s representation dated 31.03.2024, as per law, within eight weeks’ from the date of production of certified of this order alongwith copy of representation.
