Applicant seeks anticipatory bail in Case Crime No. 210 of 2021, under Section 406, 420 IPC, Police Station Pant Nagar, District Udham Singh Nagar.

Heard learned counsel for the parties and perused the record.

This is second anticipatory bail application. The first anticipatory bail application was dismissed in non prosecution on 25.04.2023.

According to the FIR, and applicant and the coaccused assured the informant that they are in a business of producing certain articles and they wanted their distributers in the State of Uttarakhand. The informant agreed to it and an agreement was entered thereafter. The informant had given money also. He was cheated.

Learned counsel for the applicant would submit that the applicant had supplied articles to the informant, which was admitted by one of the partners of the informant.

According to the State, the applicant and the coaccused have committed very serious crime. They have cheated Rs.15 lakh from the informant and his partner.

Having considered the entirety of facts, this Court is of the view that this is a case fit for anticipatory bail.

The anticipatory bail application is allowed.

¶18

In the eventuality of arrest, the applicant shall be enlarged on anticipatory bail subject to his furnishing a personal bond with two sureties, each in the like amount, to the satisfaction of the Arresting Officer (“AO”). In addition to

it, the applicant shall also comply with the following conditions:

(i) The applicant shall co-operate with the investigation.

¶21

(ii) The applicant shall not approach any witness in any manner, whatsoever.

¶22

(iii) The applicant shall not leave the country without prior permission of the concerned court.

¶23

(iv) The applicant shall deposit his passport with the AO. The passport may only be returned by the order of the court concerned. In case the

applicant does not have passport, he shall give an undertaking to that effect to the IO.

(v) The applicant shall also give an undertaking on (i), (ii) & (iii) above.
