Applicants Kamrul Hasan and Anwer are in judicial custody in Case Crime No. 1499 of 2022, under Sections 147, 148, 149, 307, 452, 506 IPC, Police Station Manglaur, District Haridwar. They have sought their release on bail.

Heard learned counsel for the parties and perused the record.

According to the FIR, on 11.12.2022, at 5:30 in the evening, the applicants and the co-accused forcibly armed with deadly weapons entered into the courtyard of Samoon and they started attacking Umar. When Ahsan came for rescue, he was assaulted and fired at due to which he sustained injuries.

Learned counsel for the applicants would submit that 13 persons have been named. But, there is only one firearm injury on the person of Ahsan, which was not fired by the applicants. He would submit that witness Salim has named the persons, who fired with the weapon.

Learned State counsel would submit that according to the witnesses, co-accused Hakim and Riyaz-ul did open fire, which caused injury to Ahsan.

It is admitted that the firearm injury was not caused by the applicants.

7 Having considered the entirety of facts, this Court is of the view that the applicants deserve to be enlarged on bail.

The bail application is allowed.

¶18

Let the applicants be released on bail, on their executing a personal bond and furnishing two reliable sureties, by each one of them, each of the like amount, to the satisfaction of the Court concerned.
