Accused–Sherkhan has sought his release on bail in connection with Case Crime/FIR No.712 of 2021, u/s 457, 380 and 34 IPC, registered at P.S. Kotwali Jwalapur, Distt. Haridwar It is argued by learned counsel that the accused has been falsely implicated; there is no recovery; he is languishing in jail since 21.12.2021; co-accused Azim Khan has already been enlarged on bail; the role assigned to the applicant is identical; he is ready to furnish the sureties; and he may be granted bail. Learned counsel for the State fairly admitted this fact. Since the co-accused Azim Khan has already been enlarged on bail, by this Court, vide order dated 22.02.2022 and the role assigned to the applicant is also similar, accordingly, without going into merits of the case, it is a fit case for bail at this stage on parity. The bail application is thus, allowed and the applicant is directed to be released on bail on his executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the Court concerned.
