This Writ Petition coming on for hearing this day, Hon’ble Shri Justice Manoj Kumar Tiwari, J. delivered the following Judgment:

JUDGEMENT

Heard learned counsel for the parties.

Petitioner has passed M.D. (Paediatrics) Course from Government Medical College, Haldwani and she had executed a bound that she will render her services in rural/ hill areas of the State of Uttarakhand. In terms of condition of the bond, petitioner was given appointment on contract as Senior Resident in Veer Chandra Garhwali Government Institute of Medical Science and Research, Srinagar, Pauri Garhwal for one year. The term of aforesaid contractual appointment has come to an end on 03.09.2021. Petitioner wants to

serve for one more year in the same Institute and, according to her; Principal of the College has also made recommendation for extending her contractual appointment.

Learned counsel for the petitioner submits that petitioner is in the family way and her husband is also serving in the same Institute, therefore a direction be issued to the Competent Authority to permit her to continue at Srinagar for one more year.

Having regard to the nature of relief claimed in the writ petition, this Court thinks that ends of justice would be met if petitioner is permitted to make a representation to the Competent Authority i.e. Secretary, Medical Education, Government of Uttarakhand.

Accordingly, writ petition is disposed of with liberty to the petitioner to make a representation to the Secretary, Medical Education, Government of Uttarakhand, within one week from today. If petitioner makes such a representation within one week, decision thereupon shall be taken within four weeks thereafter.

Subject to the above, writ petition stands disposed of finally.
