Azad, learned counsel for the informant. Accused–Gaffar has sought his release on bail in connection with Case Crime/FIR No.94/2021 u/s 323/324/326/504/506 IPC registered at P.S. Kotwali Laksar, District Haridwar. It is argued that the accused has been falsely implicated; he is languishing in jail since 28.01.2021; it was a cross-case; at first, the FIR was lodged from the accused side against the informant and others; he is ready to furnish the sureties and may be granted bail. Per contra, learned counsel for the State opposed for bail. In this matter, the accused is in jail since 28.01.2021; before lodging this FIR, another FIR was lodged against the informant and others from the accused side; as per the medical report, there is a missing upper lip of right thumb of injured; it is a matter of evidence whether it was a cross case or not, but admittedly, there are two FIRs lodged by the either side; the accused has already served more than six months in jail; it will take time to conclude the trial; thus, without making any comment on the merits, it is a fit case for bail at this stage. The bail application is thus, allowed and the applicant is directed to be released on bail on his executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the Court concerned.
