| BA1 No.523 of 2021 Hon’ble R.C. Khulbe, J. Mr. Harshpal Sekhon, learned counsel for the applicant. Mr. T.C. Aggarwal, learned DAG with Mr. Sachin Panwar, learned B.H. for the State. Applicant-Harvel Singh has sought his release on bail in connection with FIR No.651 of 2012, u/s 25 Arms Act at P.S. Kashipur, District U.S. Nagar. It is argued that the accused has been falsely implicated; the applicant has been enlarged on bail in S.T. No.169/13 u/s 302 IPC; accordingly, he is entitled for bail in the present case also. Per contra, learned counsel for the State opposed for bail but fairly admitted the said fact. Since the applicant has been enlarged on bail in S.T. No.169 of 2013 u/s 302 IPC, and this case relates to only Section 25 Arms Act, thus, without going into merits of the case, it is a fit case for bail at this stage. The bail application is allowed and the applicant is directed to be released on bail on his executing personal bond and furnishing two reliable sureties in the like amount, to the satisfaction of the Court concerned.
