| BA1 No.190 of 2021 Hon’ble R.C. Khulbe, J. Mr. Aditya Pratap Pratap, learned counsel for the applicant. Ms. Sonika Khulbe, learned B.H. for the State. Accused – Satyam has sought his release on bail in connection with Case Crime/FIR No.0623 of 2020, u/s 399, 402 of IPC, registered at P.S. Bhagwanpur, District Haridwar. It is argued that the accused has been falsely implicated; he was arrested along with co-accused at the spot. Apart from that, the co-accused, namely, Tarun Chaudhary, Vishal Sharma, Ankur Khokar and Ritik Khokar have been enlarged on bail by the lower court; he is ready to furnish the surety; and he may be granted bail on the ground of parity. Per contra, learned counsel for the State opposed for bail but fairly submitted that the above co-accused- have been enlarged on bail by the lower court. Since the above co-accused- have been enlarged on bail by the lower court; accordingly, without going into merits of the case, it is a fit case for bail at this stage on the ground of parity. Accordingly, bail application is allowed and the applicant is directed to be released on bail on the ground of parity on his executing personal bond and furnishing two reliable sureties in the like amount, to the satisfaction of the Court concerned. Pending application, if any, stands disposed of. |
