Accused – Ayyub has sought his release on bail in connection with Case Crime/ FIR No.281 of 2020, u/ s 3/ 5/ 11(1) of Uttarakhand Protection for Cow Progeny Act, 2007, registered at P.S. Kiccha, District Udham Singh Nagar. It is argued that the accused has been falsely implicated; there is no recovery against him; he was not arrested at the spot. Apart from that, the co-accused- Sarif has been enlarged on bail by the Co-ordinate Bench of this Court; he is ready to furnish the surety; and he may be granted bail on the ground of parity. Per contra, learned counsel for the State opposed for bail but fairly submitted that the co-accused- Sarif has been enlarged on bail by the Co-ordinate Bench of this Court. Since the co-accused- Sarif has been enlarged on bail by the Co-ordinate Bench of this Court; he was not arrested at the spot; there is no recovery against him; accordingly, without going into merits of the case, it is a fit case for bail at this stage on the ground of parity.
