Ms. Shivangi Gangwar, learned Brief Holder for the State. Accused- Sudhir Kumar , who is in judicial custody in connection with case crime no. 405 of 2021, under Sections 380, 457 and 411 IPC registered at P.S. Kotwali Roorkee District Haridwar has sought his release on bail. It is argued by the learned counsel for the accused that the accused has falsely been implicated; he is languishing in jail since 06.03.2021; he has no criminal history and; is ready to furnish the sureties. Per contra, learned State Counsel opposed for bail but fairly stated that accused has no criminal history. The accused is languishing in jail since 06.030.2021 having no criminal history; only two speakers were recovered from his possession; the offence is triable by the Magistrate; he has already served more than four months; accordingly, without commenting to the merit of the case it is a fit case for bail at this stage. Accordingly, bail application is allowed and the accused is directed to be released on bail on his executing a personal bond and furnishing two reliable sureties in the like amount to the satisfaction of the Court concerned.
