The petitioner before this Court is a retired District Ayurvedic Unani Officer who by means of the present writ petition has made allegations against the then Director, Ayurved & Unani, Services (respondent no.4) and then Principal of Government Rishikul Ayurvedic Post Graduate College & Hospital, Haridwar (respondent no.5). The petitioner also alleges that respondent nos.6 & 7 who conducted the inquiry are also involved in the matter as they helped respondent nos. 4 & 5 inasmuch as the inquiry report which they had submitted is not available on record.

All the officers, who are private respondents have by now have reached the age of superannuation and hence retired from service. All the petitioner needs is the implementation of the vigilance report dated 07.06.2008 where in the inquiry report of Dr. P.D. Sharma and Dr. D.N. Sharma certain officers were held responsible for irregularities in the purchase of equipment and material and departmental inquiry ought to have been initiated against them. However, this report is not available and no action has been taken against the guilty officers.

At this stage, nothing further needs to be done in the matter. However, the writ petition stands disposed with a direction to the Principal Secretary, Ayush & Ayush Education to consider the report of the vigilance dated 07.06.2008 and take an appropriate action in accordance with law.
